riday the application of STV Cable Tele vision Inc to add the signals of WPIX and WOR TV of New York City to its existing cable systems in Niagara alls the Town of Niagara the Village and the Town of Lewiston STV requested the CC grant it a waiver from leapfrogging provisions in the commission rules which provide that if a cable system wants to add the signals of independent stations AND THERE are the contin as its first and second addition al signals they must be from within one or both of the closest top 25 markets The closest of the top 25 outside the Buffalo market itself are Cleveland and Detroit STV argued the leapfrogging rules were designed to encour age cable systems to carry the signals of independent stations within their states It said that if it were allowed to carry the New York signals no in state top 25 independents would be leapfrogged STV also contend ed that it would be impractical to import the Cleveland and Detroit signals because of excessive microwave costs and it said Buffalo had greater ties with New York City than either Cleveland or Detroit Objections to the STV appli cation were filed by WBEN TV WKBW TV and WGR TV all of Buffalo In denying the STV applica tion the commission said it was unpersuaded that carriage of the New York City independ ents was essential to achieve programming that was likely to be of interest to the cable It pointed out that the rules were estab lished because without them there was a risk most cable systems would select stations from Los Angeles Chicago New York or one of the other i largest markets rather than 1
